Changes to SUNY’s Patents, Inventions, and Copyright Policy involve mandatory subjects of collective bargaining and must be bargained with UUP.
The UUP leadership welcomes member comments and suggestions as we prepare for discussions with SUNY.

All comments and information submitted through this portal will be kept confidential. At no time will the names of individual members
or information that can be connected to individual members be presented in discussions with SUNY.


SUNY's proposed changes include the following:

Patents:
The 40/60 royalty income distribution changed from gross to net; Creator would be entitled to 40 percent of net income; Current policy entitles Creator to
40 percent of gross income.

Patents & Inventions Policy Board:
This is moved out of regulations, allowing SUNY to make changes to the Board without
needing to go through the state’s official rule-making process.

Release and Waiver:
Under current policy SUNY has 6 months to act or lose all rights to royalty income on a patent.
Under the proposed policy there is no time limit on how long SUNY has to act.

Copyright
The current Title J includes a separate section on Copyright Policy, which follows the current
Patents and Inventions Policy section (pg. 49, SUNY Policies of the Board of Trustees).
SUNY's proposal for changes does not specify the place of this Copyright section in a revised Title J.
